Abstract
El fenómeno de la globalización ha generado un cambio de organización política y jurídica en la figura del Estado Nación sin que dicha modificación presente elementos institucionales que garanticen una transición pacífica, equilibrada, legítima y justa. Es en el citado contexto en el que se considera necesario fortalecer el proceso andino de integración.
La integración propiamente dicha es un status jurídico en el cual los Estados entregan el ejercicio de algunas de sus prerrogativas soberanas, con el fin de constituir un área dentro de la cual circulen libremente y reciban el mismo trato, las personas, los bienes, los servicios y los capitales, mediante la armonización de las políticas correspondientes y bajo una perspectiva supranacional (Caballero y Anzola, 1995, p.81). Dicha integración supone un proceso voluntario de institucionalización de los mecanismos que formulen interpreten y apliquen el derecho.
Abstract
The phenomenon of globalization has generated a change of political and legal organization in the figure of the Nation State without this modification presents institutional elements that guarantee a peaceful, balanced, legitimate and just transition. It is in the aforementioned context that it is considered necessary to strengthen the Andean integration process.
The integration itself is a legal status in which States give the exercise of some of their sovereign prerogatives, in order to constitute an area within which circulate freely and receive the same treatment, people, goods, services and the capitals, through the harmonization of the corresponding policies and under a supranational perspective (Caballero and Anzola, 1995, p.81). This integration implies a voluntary process of institutionalization of the mechanisms that formulate interpret and apply the law.
