Abstract
En este artículo se analizará cómo en algunos actos administrativos el derecho se enfrenta al poder, especialmente, se hablará del caso del Ex Procurador General de la Nación versus el ex Alcalde de Bogotá Gustavo Petro Urrego, quien fue declarado insubsistente para seguir en el cargo por el cual había sido elegido por voto popular.
Es necesario resaltar que Colombia es un Estado Social de Derecho y por ende, su actuar administrativo se debe aproximar a los principios constitucionales de legalidad y debido proceso y, en todo caso, que a través de estos actos, se salvaguarde el bien común y el interés general.
Abstract
In this article it will be analyzed how in some administrative acts the right faces the power, in particular, the case of the Former Attorney General of the Nation versus the former Mayor of Bogotá Gustavo Petro Urrego will be discussed, who declared him insubstant to continue in office by which he had been elected by popular vote.
It is necessary to highlight that Colombia is a Social State of Law and, therefore, its administrative action must be closer to the constitutional principles of legality and due process and, in any case, that through these acts, the common good and the general interest.
