Abstract
El presente artículo pretende dar a conocer el tipo penal de actos de discriminación, las
reformas o cambios que del mismo se han realizado, así como sus elementos y los
pronunciamientos de altas cortes sobre el mismo, ya que es un fenómeno de carácter
permanente en la sociedad y que impide la plena ejecución de los derechos inherentes a cada
persona, desconociendo el mandato constitucional y legal al respecto. También se hará
alusión a ciertas discusiones doctrinales respecto a uno de los elementos objetivos del tipo
penal como lo es el objeto jurídico, con lo cual se determinará cual es bien jurídico que tanto
en la legislación colombiana como en otras legislaciones es merecedor de protección o tutela
por parte del Estado.
Abstract
The purpose of this article is to make known the type of criminal acts of discrimination, the
reforms or changes made thereto, as well as its elements and pronouncements thereon, since
it is a permanent phenomenon in society and prevents the full implementation of the inherent
rights of each person, ignoring the constitutional and legal mandate in this regard. Reference
will also be made to certain doctrinal discussions regarding one of the objective elements of
the criminal type as it is the legal object, which will determine which is a legal right that both
Colombian law and other legislation is worthy of protection or State supervision.
