Abstract
Mediante el estudio de la legislación nacional, y la jurisprudencia y conceptos emitidos por las cortes de nuestro país, se pretende dirimir la controversia en la que se ha visto abocado la reglamentación de las facultades para contratar de los alcaldes municipales, pues mientras las corporaciones (Concejos Municipales) señalan que la constitución y la ley les autoriza limitar en modalidad, cuantía y temporalidad las facultades para contratar al burgomaestre, argumentando que dicha acción es un control político, los alcaldes arguyen que dichas restricciones corresponden a una extralimitación de funciones de las corporaciones
Abstract
Through the study of the national legislation, and the jurisprudence and the concepts emitted by the courts of our country, it is tried to settle the controversy in which has been decided the regulation of the faculties for the hiring of the municipal mayors, because while the Municipal councils) indicate that the constitution and the law authorize to limit in modality, amount and temporality the faculties to hire the burgomaster, arguing that such action is a political control, the mayors argue that the corresponding restrictions correspond to an excess of functions of the Corporations.
