¿Las sanciones por delitos de lesa humanidad y crímenes de guerra en la Justicia Especial para la Paz son compatibles con el Estatuto de Roma?

Abstract
Como objetivo general del artículo, se compararán las sanciones penales de la justicia ordinaria específicamente las señaladas en el Estatuto de Roma con las de la justicia Especial para la Paz, para los delitos de Lesa Humanidad y Crímenes de Guerra.
Investigación desde una perspectiva cualitativa, con enfoque paradigmático hermenéutico utilizando un diseño de análisis documental; contrastando la legislación interna y en especial el Estatuto de Roma con la Justicia Especial para la Paz (JEP).
Se evidencia que tanto las penas como los enfoques de estas, pertenecen a diferentes perspectivas; las unas de carácter retributivo y las otras con una visión de carácter restaurativo o prospectivo.
Sobre la compatibilidad o contradicción de unas y otras, se pude concluir que las penas conocidas como Sanciones propias, son las únicas que podrían presentar dificultad, dependiendo de su efectividad en la implementación y verificación.
Abstract
As a general objective of the article, the penal sanctions of ordinary justice will be compared specifically those indicated in the Rome Statute with those of the Special Justice for Peace, for crimes against humanity and war crimes.
Research from a qualitative perspective, with a hermeneutical paradigmatic approach using a documentary analysis design; contrasting internal legislation and especially the Rome Statute with the Special Justice for Peace (JEP).
It is evident that both the penalties and their approaches belong to different perspectives; some of a retributive nature and the others with a vision of a restorative nature.
On the compatibility of both, it can be concluded that the penalties themselves are the only ones that could present difficulty, depending on the effectiveness of their implementation and verification.
