| dc.description | El derecho debe mantenerse acorde con la evolución de los cambios sociales, es inevitable que cada vez con mayor frecuencia ante la masificación del acceso a la información, de las fuentes de información y los canales de comunicación, la confrontación entre el derecho a la intimidad/privacidad y la libertad de prensa, asociada evidentemente al de libre expresión, represente un debate interesante además de frecuente en el campo de los llamados casos difíciles en el derecho, que nos lleva a tratar de establecer cómo dirimen las altas cortes las situaciones o casos en los que colisionan estos derechos. En la actual tendencia constitucional y jurídica se ha impuesto el mecanismo de la ponderación, cuando de principios o derechos se tratan estos “enfrentamientos”, lo cual supone una herramienta que es importante comenzar a descubrir para entender su aplicación en casos concretos. | spa |
