Cases such as the death of union leaders of the subsidiaries of Coca-Cola Company Co., in Colombia, at the hands of paramilitary groups, allegedly sponsored by executives of that Company, and in which the victims have not obtained the reparation of their damages, increases the levels of impunity in the field of human rights.     Abstract

    Son frecuentes los casos de violación de derechos humanos, en los que los protagonistas son empresas transnacionales, por intermedio de sus empresas filiales presentes en Estados con débiles sistemas jurídicos, principalmente en países de Latinoamérica, Asia y África, los cuales, no cuentan con mecanismos de reclamación efectivos para garantizar los derechos humanos de las víctimas. Casos como la muerte de líderes sindicales de las filiales de Coca-Cola Company Co., en Colombia, a manos de grupos paramilitares, presuntamente auspiciados por directivos de esa misma compañía, y en la que las víctimas no han obtenido la reparación de sus perjuicios, aumenta los niveles de impunidad en materia de derechos humanos. Lo anterior, demuestra la necesidad de que se promulgue un instrumento vinculante de derechos humanos en la órbita del derecho internacional público, que permita determinar la responsabilidad internacional de las empresas transnacionales y de paso la reparación de perjuicios de las víctimas, ya que, los instrumentos actuales, como los Principios Rectores sobre Empresas y Derechos Humanos, del Consejo de Derechos Humanos de las Naciones Unidas, son disposiciones de soft law, que si bien es cierto, han impulsado la Responsabilidad Social Corporativa, no constituyen instrumentos de carácter vinculante para las corporaciones transnacionales.
     
    Les cas de violations des droits de l'homme sont fréquents, dans lesquels les protagonistes sont des sociétés transnationales, par le biais de leurs filiales présentes dans des États aux systèmes juridiques faibles, principalement dans les pays d'Amérique latine, d'Asie et d'Afrique, qui ne disposent pas de mécanismes de plainte efficaces pour garantir les droits de l'homme des victimes. Des cas tels que la mort de dirigeants syndicaux de filiales de la compagnie Coca-Cola en Colombie, aux mains de groupes paramilitaires, prétendument parrainés par des directeurs de la même compagnie, et dans lesquels les victimes n'ont pas obtenu réparation de leurs dommages, augmentent les niveaux d'impunité dans le domaine des droits de l'homme. Ce qui précède montre la nécessité d'un instrument contraignant en matière de droits de l'homme dans l'orbite du droit international public, qui permettrait de déterminer la responsabilité internationale des sociétés transnationales et, au passage, de réparer les dommages causés aux victimes, puisque les instruments actuels, tels que les Principes directeurs sur les entreprises et les droits de l'homme du Conseil des droits de l'homme des Nations unies, sont des dispositions de droit souple qui, s'il est vrai qu'elles ont favorisé la responsabilité sociale des entreprises, ne sont pas des instruments contraignants pour les sociétés transnationales.
     
    São frequentes os casos de violação dos direitos humanos, em que os protagonistas são empresas transnacionais, através das suas filiais presentes em Estados com sistemas jurídicos débeis, principalmente em países da América Latina, da Ásia e de África, que não dispõem de mecanismos de queixa eficazes para garantir os direitos humanos das vítimas. Casos como a morte de dirigentes sindicais de filiais da Coca-Cola Company Co. na Colômbia, pelas mãos de grupos paramilitares, alegadamente patrocinados por directores da mesma empresa, e em que as vítimas não obtiveram reparação pelos seus danos, aumentam os níveis de impunidade na área dos direitos humanos. O acima exposto mostra a necessidade de um instrumento vinculativo de direitos humanos na órbita do direito internacional público, que permita determinar a responsabilidade internacional das empresas transnacionais e, de passagem, a reparação dos danos às vítimas, uma vez que os instrumentos actuais, como os Princípios Orientadores das Empresas e dos Direitos Humanos do Conselho dos Direitos Humanos das Nações Unidas, são disposições de soft law , que, embora seja verdade, promoveram a Responsabilidade Social das Empresas, não são instrumentos vinculativos para as empresas transnacionais.
