Abstract
El trabajo trata acerca del concepto de “pluralismo” aplicado al ámbito étnico y jurídico, el cual ha venido siendo implementado en algunos de los nuevos ordenamientos jurídicos y constitucionales de América Latina. En consecuencia, se tratará de
explicitar, en un primer momento, el sentido del concepto de “pluralismo”, haciendo énfasis tanto en sus orígenes históricos como en su significado epistemológico (siguiendo principalmente a Boaventura de Sousa Santos). Posterior a ello, se hará un
breve análisis de las constituciones boliviana y ecuatoriana, por ser estas las más avanzadas y representativas en el tema de la diversidad étnica, con el fin de evidenciar cuáles son los aportes y características de dicho pluralismo, sus limitaciones y alcances respecto al caso colombiano. Por último, y con base en las conclusiones obtenidas en dicho análisis, el documento incluirá una reflexión acerca de las características y contradicciones surgidas en la aplicación del principio constitucional de pluralismo en Colombia.
Abstract
The paper discusses the concept of “pluralism” applied to the legal field, which has been implemented in some of the new legal and constitutional systems in Latin America, particularly in Bolivia and Ecuador. Consequently, it will try to explain, at first,
the meaning of the concept "pluralism", emphasizing both its historical origins and its epistemological significance (following Boaventura de Sousa Santos mainly). Following this, there will be a brief analysis of the Bolivian and Ecuadorian constitutions in order to demonstrate which are the contributions and characteristics of that pluralism and its similarities and differences with the Colombian case.Finally, and based on the conclusions of this analysis, the document will include a reflection on the contradictions
arising in the implementation of the constitutional principle of pluralism in Colombia.
