Abstract
En el presente documento se expone un análisis de la función preventivo general de la pena y su aplicación en la prisión domiciliaria, esto con una revisión de las sentencias de la Corte Constitucional y de la Sala Penal de la Corte Suprema de Justicia, con el fin de concluir si se debe dar mayor aplicación a dicha figura jurídica para brindar garantías a los privados de la libertad, debido a la situación de hacinamiento que se vive en el Sistema Penitenciario en Colombia.
Abstract
This document shows an analysis of the general preventive function of the penalty and its application in home detention, which reviews the sentences of the Constitutional Court and the Criminal Chamber of the Supreme Court of Justice. This, in order to conclude whether it should be given a greater application to such legal figure, to provide guarantees to those deprived of liberty, due to the overcrowding of the prison system in Colombia.
