Abstract

For Cabaña del Lomo, the use of SAS allows us to have greater flexibility in the regulation of our intra-company relationships and in the constitution of the formation document, which represents an advantage for our company because it would not be necessary to carry out statutory reforms every time the document it is about to expire. Likewise, according to Law 1258 of 2008 in article 38, the Simplified Joint Stock Company has suppression of several prohibitions that are explicit in the Commercial Code, among these are articles 155, 185, 202, 404, 435 and 454 (see Appendix 1); therefore, we would have multiple legal benefits such as the authorization to the administrators to acquire shares; permission for the majority of people on the boards of directors to be related to each other; maintain the percentage of profit distribution; administrator and employee compatibility; among others. For this reason, it is important for our organization to have a company name that enables flexible processes to be generated that reduce costs, minimize time and increase legal benefits.
