Abstract
El presente trabajo de investigación es una reflexión analítica a los postulados teóricos
propuestos en vida por el pensador latinoamericano Eduardo Rabossi a propósito de los
derechos humanos, estos pueden resumirse en dos ejes conceptuales. Uno el referido al
fenómeno de los derechos humanos el cual se perfila como un nuevo hecho cultural
universal, consensuado y validado por documentos como la carta internacional de los
derechos humanos y sus posteriores pactos. Un segundo eje apunta hacia la necesidad
de salvaguardar y efectivizar los distintos derechos que pasados por el proceso de la
positivización requieren del acompañamiento de las instituciones nacionales y
supranacionales que para tal efecto se han constituido. Es en este último aspecto donde
Rabossi plantea lo innecesario de la fundamentación de los derechos humanos
proponiendo una salida de tipo pragmático que neutralice las distintas violaciones que
actualmente se generan en este campo.
Abstract
The present work of research is an analytical reflection to the theoretical postulates
proposed in life for the Latin – American thinker Eduardo Rabossi about the human
rights these can be summarized in two conceptual axes. One of theme refered to the
phenomenon of the human rights which is outlined as a new cultural universal fact,
agreed by consensus and validated by documents as the international latter agreements.
The second axis appears as a need to safeguard and make effective the different rights
that passed by the process of positive validations require of the accompaniment of the
national and supranational institutions that for such an effect have been constituted. It
is in this latter aspect where Rabossi proposes the unnecessary of the foundation of the
rights and insists on a pragmatic exit that neutralizes the different violations that
nowadays are generated in this field.
