Abstract
La maternidad subrogada o de sustitución, es una de las técnicas de reproducción humana asistida que ha tomado auge actualmente en todos los ordenamientos jurídicos del mundo. En Colombia, la aplicación de éstas técnicas no ha sido aceptada, lo cual se refleja en la falta de iniciativa legislativa con respecto al tema, generando así un vacío jurídico en el ordenamiento que se ha tratado de llenar bajo la interpretación constitucional. En este orden de ideas, es indispensable desarrollar una legislación que regule todo lo concerniente a la materia en estudio, no solamente con respecto a la maternidad subrogada, sino también sobre las técnicas de reproducción humana asistida, para que con ello se evite, por ejemplo, la mediación lucrativa entre las partes que llegan a un acuerdo o convenio de este tipo; la desprotección de los derechos e intereses del recién nacido; los actos de disposición del propio cuerpo contrarios a la ley; y los grandes conflictos que se originan cuando surgen desacuerdos entre las partes involucradas.
Abstract
Surrogate motherhood is one of the Assisted Human Reproduction Techniques that has increased in all legal systems around the world. In Colombia, the application of this Techniques hasn´t been accepted, situation reflected in the absence of legislative initiative regarding this matter, generating a legal loophole in the legal system, which has been tried to fill by interpreting the Constitution. In this order of ideas, It is necessary to work up in a legislation capable of regulate everything concerning Assisted Human Reproduction Techniques, not only about the surrogate motherhood, thereby to avoid, for example, the profit mediation between the parties reach an agreement of this type, the vulnerability of the rights and interests of the newborn and the acts of disposal of the body itself contrary to law; and the great conflicts that arise when disagreements arise between the parties involved.
