Abstract
Este artículo tiene como objetivo analizar los desafíos del Estado frente al daño ambiental generado por la deforestación alrededor del territorio fronterizo de la Amazonia entre Colombia y Brasil y su consecuente impacto sobre el derecho humano a un ambiente sano. Por medio de una revisión bibliográfica, se mostrará inicialmente un contexto espacial y ambiental del territorio, para dar paso al análisis del daño ambiental por la deforestación y de la responsabilidad ambiental consecuente para los Estados, advirtiendo las modificaciones significativas que este daño ambiental ha causado sobre este ecosistema natural y que impactan de manera directa el derecho a gozar de un ambiente sano o equilibrado. En un tercer apartado se hará un análisis crítico de los desafíos que implica el rescate, salvaguarda y defensa de este ecosistema y del derecho humano a gozar de un ambiente sano que de él se deriva.
Abstract
This article aims to analyze the challenges of the State in the face of environmental damage generated by deforestation around the border territory of the Amazon between Colombia and Brazil. Through a bibliographical review, a spatial and environmental context of the territory will be initially shown, to give way to the analysis of the environmental damage due to deforestation and the consequent environmental responsibility for the States, noting the significant modifications that this environmental damage has caused on this natural ecosystem and that directly impact the right to enjoy a healthy or balanced environment. In a third section, there will be a critical analysis of the challenges involved in rescuing, safeguarding and defending this ecosystem and the human right to enjoy a healthy environment that derives from it, in terms of damage from deforestation.
