Abstract
Alrededor de este artículo se abarca lo concerniente al Régimen Disciplinario Actual de los 'funcionarios Públicos", por lo cual, en primer lugar realiza un recuento de la normatividad nacional acerca del tema, desde la constitución, hasta la ley más reciente, es decir, la ley 2094 (2021), teniendo en cuenta las modificaciones que realizó a la ley 1952 (2019).
Posteriormente, se presenta un análisis comparativo entre la ley 734 (2002), antiguo Código Disciplinario y la ley 1952 (2019), con el fin de dar a conocer los cambios que tuvo el "Derecho Disciplinario" en Colombia, en relación con aspectos de carácter adjetivo y sustantivo, fundamentales para el desarrollo de los "procesos disciplinarios".
Finalmente, se señalan las consecuencias a nivel jurídico que generó la expedición de la ley 1952, en especial frente a la creación de una nueva ley, debido a ciertas irregularidades que existían, con el fin de mejorar el régimen disciplinario en Colombia, a partir de la ley 2094 (2021), ya que, debían modificarse ciertas inconsistencias que presentaba el nuevo "Código General Disciplinario".
Abstract
Around this article, what concerns the Current Disciplinary Regime of 'Public Officials' is covered, for which, in the first place, it makes an account of the national regulations on the subject, from the constitution, to the most recent law, that is, Law 2094 (2021), taking into account the modifications made to Law 1952 (2019).
Subsequently, a comparative analysis is presented between Law 734 (2002), the old Disciplinary Code and Law 1952 (2019), in order to publicize the changes that the "Disciplinary Law" had in Colombia, in relation to aspects of adjective and substantive character, fundamental for the development of the "disciplinary processes".
Finally, the consequences at the legal level generated by the issuance of the 1952 law are pointed out, especially in the face of the creation of a new law, due to certain irregularities that existed, in order to improve the disciplinary regime in Colombia, from Law 2094 (2021), since certain inconsistencies presented by the new "General Disciplinary Code" had to be modified.
