Abstract
Este artículo examina el rol y el impacto de las Acciones Populares en el contexto del Derecho Administrativo en Colombia. A través de un análisis jurisprudencial y doctrinal exhaustivo, se discute el potencial que estas tienen para brindar acceso a la justicia y servir como herramientas de participación ciudadana en asuntos públicos. A pesar de las críticas respecto a la sobrecarga del sistema judicial, se argumenta que el valor intrínseco de las Acciones Populares radica en su capacidad para democratizar el acceso a recursos legales, en particular para poblaciones marginadas. El artículo concluye con una serie de recomendaciones dirigidas a mejorar la efectividad de este mecanismo legal, que van desde la revisión legislativa hasta la incorporación de tecnología en el sistema judicial.
Abstract
This paper examines the role and impact of Popular Actions within the context of Administrative Law in Colombia. Through exhaustive jurisprudential and doctrinal analysis, the potential for these to provide access to justice and serve as tools for citizen participation in public matters is discussed. Despite criticisms regarding the overburdening of the judicial system, it is argued that the intrinsic value of Popular Actions lies in their ability to democratize access to legal recourse, particularly for marginalized populations. The paper concludes with a series of recommendations aimed at improving the effectiveness of this legal mechanism, ranging from legislative review to the incorporation of technology into the judicial system.
