Abstract
El presente trabajo se centra en examinar las problemáticas que han influido en el control fiscal en Colombia, fundamentado su contexto histórico y actual. El objetivo principal es identificar mecanismos jurídicos internacionales, constitucionales y legales que puedan fortalecer el control fiscal en las contralorías departamentales, a través de la implementación de sanciones oportunas y adecuadas. Los objetivos específicos comprenden explorar los eventos políticos y administrativos que han afectado el control fiscal en Colombia, analizar la perspectiva de la Corte Constitucional y el Consejo de Estado sobre sanciones por responsabilidad fiscal en la protección del patrimonio público, y proponer mecanismos jurídicos basados en el derecho internacional, constitucional y las leyes vigentes para establecer sanciones que reparen los perjuicios derivados de una gestión fiscal inadecuada. El estudio busca mejorar la eficacia del control fiscal en Colombia al abordar los desafíos pasados y presentes mediante soluciones legales y efectivas.
Abstract
This degree work focuses on examining the problems that have influenced fiscal control in Colombia, considering its historical and current context. The main objective is to identify international, constitutional and legal mechanisms that can strengthen fiscal control in departmental comptrollers' offices, through the implementation of timely and adequate sanctions. The specific objectives include exploring the political and administrative events that have affected fiscal control in Colombia, analyzing the perspective of the Constitutional Court and the Council of State on sanctions for fiscal responsibility in the protection of public assets, and proposing legal mechanisms based on international and constitutional law and the laws in force to establish sanctions to repair the damages derived from inadequate fiscal management. The study seeks to improve the effectiveness of fiscal control in Colombia by addressing past and present challenges through legal and effective solutions.
