Repositorio Institucionalhttp://hdl.handle.net/11634/73320El presente trabajo tiene el objetivo de analizar la validez y los límites de la condena basada en un único testimonio en el proceso penal colombiano, especialmente en delitos donde la víctima es la principal o única fuente de prueba. Mediante un estudio doctrinal, jurisprudencial y analítico, se examinan los criterios que deben cumplirse para que un testimonio singular pueda constituir una fuente confiable y suficiente para una sentencia condenatoria. La metodología incluye un análisis de sentencias relevantes, así como la revisión de doctrina y principios legales, para establecer un estándar de evaluación riguroso. Los resultados demuestran que la jurisprudencia colombiana permite condenar en base a un testigo único siempre que dicho relato resista un control racional y esté respaldado por otros medios probatorios que refuercen su fiabilidad. En conclusión, el trabajo sostiene que la condena fundada en un testimonio único es jurídicamente legítima si cumple con requisitos de coherencia sustancial y corroboración periférica, garantizando así el respeto a la presunción de inocencia y la racionalidad del proceso penal colombiano.This article claims to analyze the validity and limitations of convictions based on a single witness testimony in the Colombian criminal justice system, particularly in crimes where the victim is the primary or sole source of evidence. Through a doctrinal, jurisprudential, and analytical study, the criteria that must be met for a single testimony to constitute a reliable and sufficient source for a conviction are examined. The methodology includes an analysis of relevant judgments, as well as a review of legal doctrine and principles, to establish a rigorous standard of evaluation. The results demonstrate that Colombian jurisprudence allows for convictions based on a single witness, provided that the testimony withstands rational scrutiny and is supported by other evidence that reinforces its reliability.
