Repositorio Institucional.http://hdl.handle.net/11634/45926En año 2016, en la Habana- Cuba, se da la firma de los acuerdos de paz entre el grupo insurgente conocido como Fuerzas Armadas Revolucionarias de Colombia (FARC) y el Estado colombiano, el cual cumplía 4 años de negociaciones. La firma de los diálogos entre FARC y Colombia, con miras a alcanzar una paz estable y duradera que pueda cumplir lo pactado, conlleva a revisar el fundamento jurídico, sin perjuicio de los gobiernos de turno. Se revisará las bases legales que den cuenta de la existencia de un bloque constitucional, y que siendo este un acuerdo especial de paz esté respaldado por el derecho internacional humanitario, los convenios de Ginebra y otras normas internacionales que soporten y a su vez garanticen el carácter de dicho acuerdo.In 2016, in Havana, Cuba, the peace agreements were signed between the insurgent group known as the Revolutionary Armed Forces of Colombia (FARC) and the Colombian state, which had been in negotiations for four years. The signing of the dialogues between FARC and Colombia, with a view to achieving a stable and lasting peace that can comply with the agreements, entails a review of the legal basis, without prejudice to the governments in power.
