Desde la promulgación de la Constitución de 1991, las altas cortes colombianas han sido protagonistas en la transformación y adaptación del ordenamiento jurídico del país. No obstante, la coexistencia de múltiples cortes con distintas competencias y la falta de un marco interpretativo unificado han generado una serie de retos para la consolidación de un sistema judicial coherente y confiable. El artículo destaca la importancia del papel del juez constitucional en la interpretación y aplicación del derecho, así como los dilemas que surgen de la convivencia de la doctrina probable y el precedente judicial en el sistema jurídico colombiano. A través de un exhaustivo análisis de diversas fuentes académicas y jurisprudenciales, se subraya la necesidad de un diálogo continuo entre academia, judicatura y poderes del Estado para resolver las discrepancias interpretativas y avanzar hacia un sistema más coherente y eficaz. Se concluye que aunque se han logrado avances significativos en la jurisprudencia y la práctica judicial, la unidad y coherencia en las decisiones judiciales permanecen como un objetivo a largo plazo que requiere un compromiso colectivo y un enfoque interdisciplinario.The article titled "The Evolution and Interpretative Discrepancies in the Colombian High Courts" addresses the multiple challenges and opportunities facing the judicial system in Colombia. Since the promulgation of the 1991 Constitution, the Colombian high courts have been protagonists in the transformation and adaptation of the country's legal system. However, the coexistence of multiple courts with different jurisdictions and the lack of a unified interpretative framework have generated a series of challenges for the consolidation of a coherent and reliable judicial system. The article highlights the importance of the role of the constitutional judge in the interpretation and application of the law, as well as the dilemmas that arise from the coexistence of probable doctrine and judicial precedent in the Colombian legal system. Through an exhaustive analysis of various academic and jurisprudential sources, the need for continuous dialogue between academia, the judiciary and State powers is highlighted to resolve interpretive discrepancies and move towards a more coherent and effective system.
