Lo anterior, en aras de buscar formas alternativas para resolver el conflicto planteado. Entonces, a partir de una investigación con enfoque deductivo, se determinan las problemáticas existentes en la aplicación de la mediación penal en Colombia dentro del Sistema Penal Acusatorio, a partir de su concepto, naturaleza, sus principios y fundamentos, los instrumentos jurídicos internacionales sobre la materia, la evolución normativa nacional y algunas experiencias del ordenamiento jurídico español, para concluir que éste mecanismo no permite materializar los propósitos planteados en la ley, la Constitución y la doctrina.Mediation is a legal instrument through which the victim and the accused decide the voluntary solution of an underlying conflict of the crime, through a third party called a mediator. The above, for the sake of looking for alternative ways to solve the proposed conflict.
