Para dicho efecto se realiza el estudio de fuentes primarias del orden normativo y jurisprudencial con las cuales se pretende resolver la siguiente pregunta jurídica: ¿Cuáles son los fundamentos filosóficos y jurídicos, para analizar los efectos jurídicos que se desarrollan en el ser humano cuando este adquiere la condición de cadáver en el ordenamiento jurídico colombiano? Este interrogante tiene como fundamento para su respuesta fundamentos del orden filosófico y jurídico que son analizados desde sus concepciones en un enfoque que es desarrollado desde la individualidad del ser y desde su relación con el entorno social y jurídico.The analysis of the human corpse is approached from a legal context to determine in a descriptive way its incidence in the constitutional order. For this purpose, the study of primary sources of the normative and jurisprudential order is carried out with which the following legal question is to be resolved: What are the legal effects that develop in the human being when he acquires the status of corpse? This question has as a basis for its response fundamentals of the philosophical and legal order that are analyzed from their conceptions in an approach that is developed from the individuality of being and from its relationship with the social and legal environment.
