Universidad Santo Tomás, Bucaramanga, Colombiahttp://hdl.handle.net/11634/49980Desde un estudio sistemático de la normatividad colombiana, específicamente la Constitución Política de Colombia de 1991, Ley 1562 de 2012 y los conceptos emitidos por las entidades públicas en calidad de actores del Sistema General de Riesgos Laborales (SGRL), se evidencia incertidumbre respecto de si de la afiliación al enunciado sistema frente a las personas vinculadas mediante Contrato de Prestación de Servicios, es de carácter obligatorio o voluntario. Así, el propósito esencial de este trabajo se centra establecer la obligatoriedad de afiliación al Sistema General de Riesgos Laborales con ocasión a un Contrato De Prestación de Servicios. Para ello, se realizó una investigación jurídica con enfoque cualitativo, en complemento con una revisión bibliográfica enfocada en compilar los fundamentos y normativas existentes respecto del precitado Sistema. Conforme lo anterior, se procede a detallar la afiliación al SGRL respecto a un contrato de prestación de servicios, para luego determinar la obligatoriedad de afiliación al SGRL en el marco de un contrato de prestación de serviciosFrom a systematic study of Colombian regulations, specifically the Political Constitution of Colombia of 1991, Law 1562 of 2012 and the concepts published by public entities as actors of the General System of Occupational Risks, there is evidence of uncertainty regarding whether of the affiliation to the statement of the system in front of the people linked by Contract for the Provision of Services, is mandatory or voluntary. Thus, the essential purpose of this work is focused on establishing the obligation of affiliation to the General System of Occupational Risks on the occasion of a Contract for the Provision of Services. For this, a legal investigation with a qualitative approach was carried out, in addition to a bibliographic review focused on compiling the existing foundations and regulations regarding the aforementioned System.
