La pregunta problémica planteada gira en torno a determinar si ¿es jurídicamente admisible la aplicación de la figura procesal del desistimiento tácito en los procesos de jurisdicción coactiva? Para ello, es necesario definir los procesos de jurisdicción coactiva en el ordenamiento jurídico colombiano. A su turno, delimitar conceptualmente la figura procesal del desistimiento tácito y su aplicación en los procesos ejecutivos ordinarios. Finalmente, identificar la aplicación del desistimiento tácito en la jurisprudencia del Consejo de Estado. El estudio se realizará revisando las fuentes legales que definen la jurisdicción coactiva y el desistimiento tácito, así como la construcción doctrinal en torno al tema y los pronunciamientos jurisprudenciales que se han realizado en punto a la figura del desistimiento tácito.The present work is designed to study the legal admissibility of the application of the procedural figure of tacit withdrawal in the processes of coercive jurisdiction. The problematic question raised revolves around determining whether the application of the procedural figure of tacit withdrawal in coercive jurisdiction processes is legally admissible? For this, it is necessary to define the processes of coercive jurisdiction in the Colombian legal system. In turn, conceptually delimit the procedural figure of tacit withdrawal and its application in ordinary executive processes. Finally, identify the application of the tacit withdrawal in the jurisprudence of the Council of State.
