Dentro de éste contexto se analizará lo concerniente a la responsabilidad del Estado por el hecho u omisión del Legislador, teniendo en cuenta los antecedentes de violencia, despojo y abandono forzado de tierras que precedieron a la expedición de la Ley 1448 de 2011, con el fin de determinar si es imputable algún tipo de responsabilidad al Estado por los problemas que se han presentado con la aplicación de ésta ley, especialmente en el caso de los denominados “segundos ocupantes” en los procesos de Restitución de Tierras. Within this context, it will be analyzed the State's responsibility for the act or omission of the Lawgiver, taking into account the history of violence, dispossession and forced abandonment of land that preceded the enactment of Law 1448 of 2011, in order to determine whether any liability attributable to the State for the problems that have arisen with the implementation of this law, especially in the case of so-called " seconds occupiers " in the process of land restitution.
