(Trabajo de Grado/Maestría, Universidad Santo Tomás) Repositorio Institucional.http://hdl.handle.net/11634/55308La contratación del estado en Colombia desde sus inicios fue estructurada entorno a principios rectores que la dirigen, incluidos en ella el principio de planeación y el de selección objetiva. Estos principios son palpables a través de la doctrina, las sentencias del Consejo de Estado y la Corte Constitucional, por medio de las cuales desarrolla la interpretación de los principios citados en cuanto a su concepto y alcance. Asi las cosas, el principio de planeación, se ubica en la etapa precontractual del proceso administrativo de contratación pública donde fungen los comités estructuradores y evaluadores (económico, técnico y jurídico) y es apreciado como el fundamento primigenio de la contratación estatal, entendido como el engranaje fundamental del proceso que dirige y representa. De igual forma, el principio de objetividad se obtiene de la puesta en marcha del cumulo de contratos provistos por el estado, sin importar si son de origen privado o administrativo, sin distingo de su valor, aplicándose de forma perpendicular, y encontrándose en todas las etapas del proceso.State contracting in Colombia from its beginnings was structured around guiding principles that direct it, including the principle of planning and objective selection. These principles are palpable through the doctrine, the rulings of the Council of State and the Constitutional Court, through which the interpretation of the aforementioned principles is developed in terms of their concept and scope. Thus, the planning principle is located in the pre-contractual stage of the administrative process of public contracting where the structuring and evaluating committees (economic, technical and legal) serve and is appreciated as the primary foundation of state contracting, understood as the fundamental gear of the process that directs and represents.
