Repositorio Institucional.http://hdl.handle.net/11634/44040El debate académico y jurídico en el derecho colombiano se ha centrado en revisar continuamente la relación jurídica entre el derecho colombiano, y la Corte IDH, lo que conocemos como el estudio del control de convencionalidad en aplicación del principio de subsidiariedad. En este sentido, la sentencia Petro Urrego vs Colombia avivó tal debate y determinó la violación del artículo 23 de la Convención referente a los derechos políticos, por parte de la Procuraduría General de la Nación en adelante PGN y del Sistema Disciplinario colombiano que lo sostiene. Por tales motivos, la presente investigación se propone estudiar la competencia de la Procuraduría en los casos de juzgamiento disciplinario a funcionarios de elección popular, en base a la jurisprudencia de la Corte Constitucional y de la Corte Interamericana en la materia y los derechos políticos para generar un análisis holístico.The academic and legal debate in Colombian law has focused on continually reviewing the legal relationship between Colombian law and the Inter-American Court, what we know as the study of conventionality control in application of the principle of subsidiarity. In this sense, the Petro Urrego v.
