2025-02-052025-02-05http://hdl.handle.net/11634/63473The present article is a short analysis about the construction of de new social global movement from thespaces of World Social Forum (WSF) and the form in these different and multicultural movements hasbeen building news forms of knowledge, from the social action, that create controversy, but also from thetheory, front the absence of guaranty of human rights.The article proposes that the socials movements, judicial operator, the theorist and the professionalsconsider about the inconvenience of the use of the Theory of the Generations of the Humans Rights,because this vision isn’t gratuitous and has orient serious the division of the humans rights in categories:first, second, third, etc. This division has been incorporating in the majority of constitutionals texts and theconstitutionals courts has been accepting this theory how assessment indicator, giving effective custodyto any rights in damage of “the others rights”.The text proposes the consolidation of a new theory, the Generation of Vienna, based on the recovery ofthe right to the history and integrity, interdependence and unit of human rights laid down in Article 5 ofthe Declaration and Plan of Vienna Action signed by 171 states.El presente artículo es un breve análisis sobre la construcción de un nuevo movimiento social global desde los espacios del Foro Social Mundial y la forma como estos movimientos diversos y multiculturales han venido construyendo nuevas formas de conocimiento desde la acción social que recrean y cuestionan, también desde la teoría, la ausencia de garantía para los Derechos Humanos. Se propone que los movimiento sociales, los operadores judiciales, los teóricos y los profesionales reflexio- nen sobre la inconveniencia de seguir utilizando la llamada Teoría de las Generaciones de los Derechos Humanos, ya que esta visión no es para nada gratuita y ha orientado de manera grave la división de los Derechos Humanos en categorías: primera, segunda, tercera, etc. Esta división se ha incorporado en la mayoría de textos constitucionales y los tribunales constitucionales, los cuales han seguido esta teoría como parámetro de valoración dando tutela efectiva a algunos derechos en detrimento de “los otros derechos”. El texto propone la consolidación de una nueva teoría, la de la Generación de Viena, basada en la recupe- ración del derecho a la historia y en la integralidad, interdependencia y unidad de los Derechos Humanos establecido en el artículo 5º de la Declaración y el Plan de Acción de Viena suscrito por 171 estados.application/pdfGlobalizationHumans RightsSocial movementWorld Social ForumNew Theory of Humans RightsDeclaration and Action Plan of VienaGlobalizaciónDerechos Humanosmovimientos socialesForo Social MundialNueva teoría de los Derechos HumanosDeclaración y Plan de Acción de Vienainfo:eu-repo/semantics/article
