Partiendo del hecho de que, cuando se crea la figura en el derecho público a esta se le asignan unas funciones enteramente técnicas, y en este sentido su responsabilidad; esto es, responder por fallas en el actuar técnico de su rol como interventor en los contratos. Sin embargo, luego el legislador, a través de varias modificaciones a la ley que los rige, cargó de una mayor responsabilidad jurídica a quienes desempeñan esta figura, llegando al panorama actual, en donde el interventor responde civil, fiscalmente, de manera solidaria con el contratista, y en forma individual penal y disciplinariamente por las acciones y omisiones que de sus actuaciones deriven un incumplimiento del contrato de obra, extendiendo estas responsabilidades hasta la liquidación del contrato, teniendo en cuenta que, su vigilancia y controle generaba solo en la etapa contractual.This document develops what is the scope of the responsibility of the controller in the work contracts entered into in Colombia. Based on the fact that, when the figure is created in public law, it is assigned entirely technical functions, and in this sense its responsibility; that is, answer for failures in the technical performance of its role as controller in contracts.
