Tunja.http://hdl.handle.net/11634/42535El derecho administrativo colombiano se ha edificado a partir del principio de legalidad, y siguiendo a RODRIGUEZ (2013, 311 p.) se ha entendido que la administración está sujeta en su actividad al ordenamiento jurídico, y por tanto, sus actos deben guardar coherencia con las normas superiores . Pero lo cierto es que, en lo que atañe al sistema de fuentes del derecho, no solamente la ley en sentido estricto, es la única norma a la cual está sujeta la administración, y por ende, el principio de legalidad se limita a ésta. En ese orden, aunque es un tema ya aceptado, de acuerdo al modelo constitucional adoptado por el estado Colombiano, en cuanto a jerarquía de validez normativa, es la Constitución la que irradia el sistema de fuentes, por mandato expreso de los artículo 4 y 241 de la Carta.Colombian administrative law has been built on the principle of legality, and following RODRIGUEZ (2013, 311 p.), it has been understood that the administration is subject to the legal system in its activity, and therefore, its acts must be consistent with the higher standards. But the truth is that, as far as the system of sources of law is concerned, there is no only the law in the strict sense, is the only norm to which the administration is subject, and therefore, the principle of legality is limited to it.
