Repositorio Institucional.http://hdl.handle.net/11634/59587El presente artículo busca exponer cuál ha sido el papel del Juez Contencioso Administrativo en la protección del derecho al agua en Boyacá, a través de la protección del servicio público domiciliario de acueducto, a partir del análisis de las jurisprudencias proferidas dentro del medio de control de protección de derechos e intereses colectivos o también denominado acción popular que cursaron en primera o segunda instancia en el Tribunal Administrativo de Boyacá. Los hallazgos de la investigación muestran que dicha Corporación ha sostenido en el tiempo, decisiones de reconocimiento y protección del acceso al agua para consumo humano en su manifestación colectiva, a través de ordenar la eficiente y adecuada prestación del servicio público de acueducto. Las características del precedente sentado, su vigencia en el presente y algunas conclusiones, se encuentran descritas en el cuerpo del siguiente texto.This article aims to expose the role of the Administrative Judge in protecting the right to water in Boyacá, through the protection of the public service of drinking water supply, based on the analysis of jurisprudence issued within the means of control of protection of collective rights and interests or also called popular action that took place in the first or second instance in the Administrative Tribunal of Boyacá. The findings of the investigation show that this Corporation has maintained over time, decisions recognizing and protecting access to water for human consumption in its collective manifestation, through ordering the efficient and adequate provision of the public service of drinking water supply.
