Sin embargo, es pertinente analizar si se han otorgado garantías idóneas a la democracia como derecho fundamental, para preservar el ejercicio de este derecho. En primera instancia, se analizará el derecho fundamental a la democracia, para posteriormente identificar las garantías que protegen este derecho, con el fin de construir criterios que permitan valorar su idoneidad, a partir de casos en los que se han aplicado distintos mecanismos de protección. Lo anterior se hará a través de una valoración argumentativa y desde la teoría de los derechos fundamentales, como categoría de derechos de rango superior que dan sustento al modelo mismo de Estado.Although democracy has been conceived as a form of government, it is now possible to define it as a fundamental right. However, it is pertinent to analyze whether suitable guarantees have been granted democracy as a fundamental right, in order to preserve the exercise of this right.
