En el desarrollo del asunto problemático, se podrá evidenciar el nivel de eficiencia del accionar del Estado y la trascendencia del mecanismo de tutela, reflejada en el activo protagonismo de la función judicial, en defensa del derecho precautelado. Finalmente, se exponen estrategias que coadyuvan a la resolución del problema planteado, en aras de la accesibilidad oportuna y eficiente a medicamentos, en consecución del derecho a la salud y la materialización del Estado Social de Derecho.The purpose of this research is to show the current situation of the Colombian health system with respect to the state’s function of controlling the price of medicines and its impact on the protection of the fundamental right to health. In the development of this problematic issue, it will be possible to evidence the level of efficiency of the State’s actions and the transcendence of the mechanism of protection, reflected in the active protagonism of the judicial function, in defense of the protected right.
