Tesis posgrado, Universidad Santo Tomás, Tunja.http://hdl.handle.net/11634/49254Los productos cosméticos hacen parte de la vida diaria de la comunidad colombiana, desde el primer momento del día, como de las últimas actividades antes de proceder a descansar, como limpieza de los dientes y las mucosas bucales, lo que comúnmente se reconoce, con la acción de “cepillarse los dientes”, o para algunas personas, la acción de maquillaje o limpiar el rostro para desmaquillarse mediante cremas que describen la función, o el uso de un bloqueador solar. Teniendo en cuenta que el uso y consumo de los productos Cosméticos, tienen directa incidencia sobre la salud humana, se ha procurado emitir medidas jurídicas de orden nacional y supranacional, que tiene por objeto regular las condiciones de seguridad y calidad para la fabricación, distribución y comercialización para estos productos, en pro de proteger a los consumidores que adquieren estos productos para su uso; en consecuencia, el marco normativo tiene por finalidad salvaguardar la vida y salud de los consumidores, por encima del beneficio económico de cualquier comercializador o fabricante, en ejercicio de la libertad económica. Sin embargo, la misma comunidad o población no tiene conocimiento de cuáles son las Entidades del orden Nacional que vigilan y controlan los productos que hemos mencionado, a saber, los productos cosméticos y las herramientas jurídicas o legales que pueden prevenir un riesgo, peligro o impacto a la salud pública. En idéntico sentido, el titular de un producto cosméticos, quien tiene la carga del deber de seguridad y responsabilidad frente a los daños que le pueda causar su producto y hasta donde el ejercicio de la libertad económica puede verse limitado por un marco normativo vigente, por lo cual, se estudia tanto los requisitos y trámites que deben cumplir, las herramientas administrativas con las que cuenta la autoridad competente y si las mismas son eficientes para proteger la salud pública de la comunidad.Cosmetic products are part of the daily life of the Colombian community, from the first moment of the day, as well as the last activities before proceeding to rest, such as cleaning teeth and oral mucosa, which is commonly recognized, with the action of "brushing teeth", or for some people, the action of makeup or cleansing the face to remove makeup using creams that describe the function, or the use of sunscreen.
