Repositorio Institucional.http://hdl.handle.net/11634/69794Este trabajo analiza el papel transformador del artículo 2 de la Convención Americana sobre Derechos Humanos en la configuración de un modelo de gobernanza regional en América Latina. A través de un enfoque cualitativo, basado en la revisión teórica del constitucionalismo global y un análisis jurisprudencial de la Corte Interamericana de Derechos Humanos, se demuestra que esta disposición ha sido interpretada como un mandato vinculante que exige a los Estados parte reformar sus marcos normativos internos para garantizar un núcleo de derechos contenidos en la Convención Americana. Se identifican patrones comunes en las sentencias que ordenan reformas estructurales en áreas como la libertad de expresión, los derechos políticos, la integridad personal y la protección de poblaciones vulnerables. Estos derechos, vinculados a principios universales y al interés público global, constituyen un patrimonio normativo común no disponible para el poder estatal. En este contexto, el Sistema Interamericano actúa como un mecanismo de integración jurídica y de gobernanza regional, consolidando un orden jurídico compartido en el hemisferio.This paper analyzes the transformative role of Article 2 of the American Convention on Human Rights in shaping a regional governance model in Latin America. Through a qualitative approach, based on a theoretical review of global constitutionalism and a jurisprudential analysis of the Inter-American Court of Human Rights, it demonstrates that this provision has been interpreted as a binding mandate requiring State parties to reform their domestic legal frameworks to ensure a core set of rights enshrined in the American Convention. Common patterns are identified in the Court’s rulings that order structural reforms in areas such as freedom of expression, political rights, personal integrity, and the protection of vulnerable populations. These rights, grounded in universal principles and the global public interest, constitute a shared normative heritage that is not subject to state discretion.
