Las Tecnologías de la Información y las Comunicaciones, han permitido que la Economía Colaborativa se desarrolle con gran agilidad, rompiendo barreras de regulaciones estatales y proponiendo retos al Derecho del Trabajo respecto a la protección de derechos de trabajadores vinculados a plataformas digitales que ofrecen diferentes bienes y servicios, pretendiendo desconocer la relación laboral entre éstas y los prestadores de servicios. Fue necesario analizar el fenómeno en Colombia, respecto a si la Legislación Laboral es suficiente para la protección de los derechos de los individuos prestadores de servicios o, si se requieren cambios normativos contundentes para propender su protección, concluyendo que transformando la orientación interpretativa del trabajo desde la teoría finalista, no es suficiente satisfacer el objetivo del derecho del trabajo y se sugiere emitir legislación novedosa que involucre la protección de derechos del trabajador por su actividad y no por su denominación.
Abstract
Information and the Communication Technologies have allowed the Collaborative Economy develops with great agility, breaking barriers of state regulations and proposing challenges to the Labor Law regarding the protection of worker’s rights linked to digital platforms that offer different goods and services, pretending to ignore the employment relationship between them and the services providers. It was necessary to analyze the phenomenon in Colombia, regarding whether the Labor Legislation is enough for the protection of the rights of individuals service providers, or if forceful normative changes are required to promote their protection, concluding that transforming the interpretive orientation of the work from the finalist theory, it is not enough to satisfy the target of the labor law and it is suggested to issue new legislation that involves the protection of the worker’s rights by their activity and not by their denomination.
