Este artículo tiene dos objetivos primordiales. En primer lugar, busca hacer una lectura y un análisis de la relación de los migrantes venezolanos en condición de irregularidad migratoria VIH+ con las normas jurídicas que regulan el acceso al SGSSS colombiano, siendo un análisis con un sustrato dogmático. Para de esta manera desentrañar si existe una relación de exclusión o inclusión de la población migrante. En segundo lugar, pretende realizar un análisis desde la teoría jurídica para mostrar como el derecho perpetuo la exclusión de estos sujetos de la gama de derechos, siendo una manifestación violenta de las normas jurídicas.
This article has two main objectives. In the first place, it seeks to make a reading and an analysis of the relationship of Venezuelan irregular migrants, infected with HIV, with the legal norms that regulate access to health system. In order to discover if there is a relationship of exclusion or inclusion of the migrant population. Second, it aims to carry out an analysis from legal theory to show how law excludes these subjects from the guarantee of rights, a phenomenon that can be catalogues as a violent manifestation of legal norms.
