Own sanctions in the Special Justice for Peace and the Rome Statute

Resumen
Como objetivo general del artículo, se compararán las sanciones propias señaladas en la Justicia Especial para la Paz con las del Estatuto de Roma, para los delitos de Lesa Humanidad y Crímenes de Guerra y su posible compatibilidad a fin de evitar el ejercicio de la jurisdicción internacional. Investigación inicia atendiendo a algunos aspectos preliminares de contextualización del tema y la primera parte atiende a los puntos 1. Las penas en la legislación colombiana. 2. Las penas en el estatuto de roma y 3. Las sanciones en la justicia especial para la paz. Contrastando los instrumentos para los delitos de lesa humanidad y crímenes de guerra. En la segunda parte tenemos el punto 4. Enfoque de las sanciones. Donde se abordan las penas de los diferentes textos legales y los enfoques de estas, que pertenecen a diferentes perspectivas; las unas de carácter retributivo y las otras con una visión de carácter restaurativo. Finalmente se examina sobre la compatibilidad de unos y otros instrumentos legales, en el punto 5. Penas propias e impunidad. Para concluir que las penas propias son las únicas que podrían presentar dificultad, dado el difícil reto de la supervisión visto en el punto 6. Régimen de control de la restricción de la libertad. De la efectividad de su implementación y verificación, depende su carácter genuino o una burla las víctimas.
The general objective of the article is to compare the self-imposed sanctions indicated in the Special Jurisdiction for Peace with those of the Rome Statute for the crimes of Human Rights Violations and War Crimes, and their compatibility in order to avoid the exercise of international jurisdiction. The investigation begins by addressing some preliminary aspects of contextualization of the topic, and the first part focuses on the following points: 1. Penalties in Colombian legislation; 2. Penalties in the Rome Statute; and 3. Sanctions in the Special Jurisdiction for Peace. Contrasting the instruments for crimes of human rights violations and war crimes. The second part examines point 4. Approaches to sanctions, addressing the penalties in the different legal texts and their perspectives, which belong to different frameworks: some with a retributive nature and others with a restorative vision. Finally, point 5 explores the compatibility of both legal instruments in relation to self-imposed penalties and impunity. The conclusion is that self-imposed penalties are the only ones that could present difficulties, given the challenging task of supervision, as discussed in point 6. Control regime of liberty restrictions. The genuineness or mockery of the victims depends on the effectiveness of its implementation and verification.
