En este trabajo se aprecia el desarrollo normativo y jurisprudencial que ha tenido la doble militancia en la modalidad de apoyo, cuando se presentan coaliciones políticas. En primer lugar, se observa el proceso que ha tenido la doble militancia en Colombia desde una perspectiva histórica y legal para de esta manera dar paso a lo que la jurisprudencia de la Corte Constitucional y del Consejo de Estado ha establecido sobre el tema en cuestión, aspecto
fundamental para la creación de la línea jurisprudencial que se encuentra en la segunda parte decuerpo de la investigación; dentro del análisis de los fallos de estas altas corporaciones se vislumbrara las sentencias que se constituyen en inicio, hito y referencia para la doble militancia en Colombia, finalmente se estudia una sentencia relevante de la sala quinta del Consejo de Estado sobre el tema en cuestión, con el propósito de observar las consecuencias tanto positivas como negativas, para la población colombiana con base en el voto programático y para la estabilidad política y administrativa del país.
Abstract
In this work you will appreciate the development of normative and jurisprudential of the double
militancy in the form of support, when there are political coalitions.
In first step you will watch the process that the double militancy have had in Colombia from a
history and legal perspective and in this way give way to the jurisprudence of the constitutional
court and the council of state about the topic in question, important aspect to the creation of the
jurisprudential line, that stay in the second place of the body of the investigation; inside of the
analysis of these courts you will find the most important rulings of the topic and all the reference
to the double militancy in Colombia, finally you will study one sentence of the fifth room of
council state, about this issue, whit the purpose of see the positive and negative consequences,
for the Colombian population based on the programmatic vote and to the political and
administrative of the country
