La Inteligencia Artificial ha sido reconocida como la nueva tecnología que ha revolucionado a la humanidad, por ende, resulta pertinente adoptar esta tecnología en el sector de la contratación pública, toda vez que, contribuye con el cumplimiento de los principios de la contratación, en especial respecto al principio de economía, celeridad y transparencia.
De ahí que, países como España y Hungría implementaron sistemas de Inteligencia Artificial en el desarrollo de Procesos Contractuales, con la finalidad de prevenir y detectar riesgos en la contratación pública, en aras de garantizar la adecuada gestión de los recursos Públicos. Por su parte, en Colombia se han expedido dos Documentos CONPES relacionados con la adopción de la IA en el sector público, tales como el Documento CONPES 3974 de 2024 y el Documento 4144 de 2025 referente a la Política Nacional de Inteligencia Artificial.
En razón a lo anterior, a través de este trabajo de investigación se busca identificar cómo puede utilizarse la Inteligencia Artificial para la ejecución de los contratos de interventoría atendiendo a criterios de transparencia y economía.
Por ello, el primer capítulo se centra en describir el funcionamiento de la Inteligencia Artificial y sus posibles aplicaciones en la compra pública a nivel internacional y colombiano, mientras que el segundo capítulo realiza un análisis legal respecto del contrato de interventoría y las modificaciones que pueden realizarse en su ejecución, por último, el tercer capítulo se encarga de proponer recomendaciones referentes a la implementación de la Inteligencia Artificial en la ejecución de contratos de interventoría.
Abstract
Artificial Intelligence has been recognized as the new technology that has revolutionized humanity, therefore, it is pertinent to adopt this technology in the public procurement sector, since it contributes to compliance with the principles of contracting, especially with respect to the principle of economy, speed and transparency.
Hence, countries such as Spain and Hungary implemented Artificial Intelligence systems in the development of Contractual Processes, in order to prevent and detect risks in public procurement, in order to guarantee the proper management of Public resources. For its part, in Colombia, two CONPES Documents have been issued related to the adoption of AI in the public sector, such as CONPES Document 3974 of 2024 and Document 4144 of 2025 regarding the National Artificial Intelligence Policy.
Based on the above, through this research work we seek to identify how Artificial Intelligence can be used for the execution of supervision contracts according to criteria of transparency and economy.
Therefore, the first chapter focuses on describing the functioning of Artificial Intelligence and its possible applications in public procurement at the international and Colombian level, while the second chapter carries out a legal analysis regarding the supervision contract and the modifications that can be made in its execution.
Finally, the third chapter is responsible for proposing recommendations regarding the implementation of Artificial Intelligence in the execution of supervision contracts.
