El Acuerdo Marco de Precios es un instrumento que se utiliza para agregar demanda, constituido como un mecanismo por medio del cual se implementa la modalidad de selección de contratista correspondiente a la selección abreviada, en especial para adquirir bienes y servicios que cuentan con “características técnicas uniformes y no uniformes”, cuya utilización es común, el cual se creó mediante la ley 1150 del año 2007 y posteriormente fue reglamentado mediante el Decreto 1082 expedido en el año 2015. Sin embargo, es importante analizar el impacto de estos acuerdos respecto al manejo del patrimonio estatal, por ende, mediante este artículo se pretende determinar la eficiencia en
cuanto a la aplicación de los AMP en los procesos contractuales adelantados por entidades estatales en Colombia, en cuanto a la disminución de costos para las mismas, en relación con los precios disponibles en el mercado.Por consiguiente, mediante el contenido de este artículo se realiza un análisis previo del Acuerdo Marco de Precios, a través del método cualitativo, bajo el desarrollo de tres capítulos, el
primero se centra en identificar el origen, concepto, características y condiciones de aplicación de este mecanismo como mecanismo utilizado para adquirir bienes y servicios en el ámbito de la contratación pública. A su vez, en el segundo capítulo se desarrolla un análisis legal del AMP, en especial respecto a la obligatoriedad de su implementación a partir de la ley 1150 de 2007, finalmente, el tercer capítulo hace referencia al impacto económico del Acuerdo Marco de Precios en la Contratación pública, principalmente respecto a la eficiencia del gasto público.
Abstract
The Framework Price Agreement is an instrument used to aggregate demand, constituted as a mechanism through which the contractor selection modality corresponding to the
abbreviated selection is implemented, especially to acquire goods and services that have “uniform and non-uniform technical characteristics”, whose use is common, which was created
by Law 1150 of 2007 and was subsequently regulated by Decree 1082 issued in 2015.
However, it is important to analyze the impact of these agreements on the management of state assets, therefore, through this article we intend to determine the efficiency in terms of the
application of the AMP in the contractual processes carried out by state entities in Colombia, with respect to the reduction of costs for state entities, in relation to the prices available in the
market. Therefore, through the content of this article, a preliminary analysis of the Framework Price Agreement is carried out, using the qualitative method, under the development of three
chapters, the first one focuses on identifying the origin, concept, characteristics and conditions of application of the same as a mechanism used to acquire goods and services in the field of public procurement. In turn, in the second chapter, a legal analysis of the AMP is developed, especially with respect to the mandatory nature of its implementation as of Law 1150 of 2007; finally, the third chapter refers to the economic impact of the Framework Price Agreement on Public Procurement, mainly with respect to the efficiency of public spending.
