El desempaque del derecho a la protesta social en el sistema interamericano de derechos humanos: garantías frente a su criminalización y represión

dc.descriptionEl derecho a la protesta social en nuestras democracias actuales goza del estatus de derecho humano fundamental. Además, este derecho es entendido como necesario para el desarrollo del principio democrático del Estado Social de Derecho, y para el correlativo ejercicio de otros derechos humanos y libertades fundamentales. No obstante, la prominente importancia de este derecho es permeada por la constante presencia de fenómenos que criminalizan y reprimen el ejercicio de la protesta social. En ese estado de cosas, en este artículo de investigación, mediante el uso de la metodología del desempaque de los derechos humanos, se muestran aquellos derechos que necesariamente comprende la protesta social en el Sistema Interamericano de Derechos Humanos, como la libertad de expresión, el derecho de reunión y la libertad de asociación. De otra parte, y con la misma metodología se logra establecer un marco de garantías (obligaciones) que los Estados deben cumplir en este sistema y que son necesarias para la protección del derecho a protestar ante fenómenos que vulneran su ejercicio, como la criminalización y represión.es-ES
dc.descriptionThe right to protest in our current democracies is a human and fundamental right. As well, this right is considered necessary to develop the democratic principle of the Social Rule of Law and the correlative exercise of other human rights and fundamental liberties. However, this superior value of this right is permeated by the constant presence of phenomena that criminalize and repress the exercise of social protest. In this context, this paper, using the human rights unpacking methodology, shows the rights that necessarily include the social protest in the Inter-American system of human rights, like the freedom of expression, the liberty of assembly, and the freedom of association. From elsewhere and using the same methodology, it is possible to establish a legal framework of obligations that the States must respect in this system and are necessary to protect the right to protest against phenomena that violate their exercise.en-US
