Este artículo se enfoca en el reconocimiento que la Corte Constitucional colombiana ha alcanzado sobre el deber estatal de memoria, uno de los componentes del derecho a la verdad. Lo anterior requiere (a) una breve referencia a la verdad conforme su consagración progresiva en el derecho internacional y en el estándar interamericano, con especial atención en el deber de memoria; (b) un recuento de la jurisprudencia constitucional acerca de dicho deber, destacando la ubicación que la Corte le asigna en la Carta Política y conforme el seguimiento a la evolución internacional sobre el tema; y, (c el estudio concreto de pronunciamientos recientes del Tribunal sobre el deber de memoria y la prohibición del negacionismo. Culmina con anotaciones puntuales, tanto deductivas sobre el reconocimiento progresivo de este deber en el precedente constitucional, como críticas y con miras a aportar al debate en espacios académicos, normativos y políticos, a propósito del proceso histórico que ha vivido nuestro país, coincidente con la vigencia de la actual Constitución y con procesos de paz y cese del conflicto armado.
This article focuses on the recognition achieved by the Colombian Constitutional Court regarding the State duty of memory, one of the components of the right to the truth. This requires: (a) a brief reference to the concept of truth as it has been progressively enshrined in international law and within the Inter-American standard, with particular attention to the duty of memory; (b) an overview of constitutional jurisprudence on this duty, highlighting the place the Court assigns to it within the Constitution and in light of its monitoring of international developments on the subject; and (c) a specific analysis of recent rulings of the Court concerning the duty of memory and the prohibition of denialism. The article concludes with focused remarks, both deductive—regarding the progressive recognition of this duty in constitutional precedent—and critical, aimed at contributing to the debate in academic, normative, and political arenas, in light of the historical process experienced by Colombia, which coincides with the period of validity of the current Constitution and with peace processes and the cessation of the armed conflict.
