Actualmente, los contratos inteligentes se han consolidado como herramientas revolucionarias en el ámbito financiero, particularmente en el sector de la tecnología financiera (Fintech). No obstante, más allá de su carácter innovador, estos contratos presentan importantes desafíos legales y operativos en su implementación. Este artículo, desarrollado bajo el método de análisis-síntesis, se centra en examinar los retos jurídicos relacionados con la validación y el reconocimiento de los contratos inteligentes desde un enfoque normativo, sin abordar aspectos técnicos de su creación. Asimismo, se analiza su integración en las operaciones y servicios financieros proporcionados por las Fintech, destacando su relevancia e impacto en este sector. Los contratos inteligentes tienen un potencial clave para transformar la industria financiera, lo que hace imprescindible una adecuada comprensión de los desafíos legales que estos plantean en el marco regulatorio actual.
In the current context, smart contracts have emerged as revolutionary tools in the financial sector, particularly within the field of financial technology (Fintech). However, beyond their innovative nature, these contracts present significant legal and operational challenges in their implementation.
