dc.descriptionWhenever we refer to diplomatic immunity, we relate to the principle Equality sovereingbetween States, (Par In Parem Not Habet Imperium), understood as the absolute inability toturn jurisdiction to another State, including its agents in the field they are known as internationaldiplomatic agents.The new trend in immunity to the concept of immunity Restricted, which should apply onlyin cases in which a State or its agents run their own function actions (Jure imperi), otherwisethe current rules applied in the forum state.It is due to this new trend we must evolve and change the old absolutist mentality on immunitycourt came to prevail, harmonized with the era of human rights and their effectiveenjoyment, trying to define the thin line that separates Immunity from Impunity, and thisonly it is achieved when the legislators and judges who are in charge of uttering and enforcelaws governing citizens and foreigners who are in the country, understand the importanceand necessity of setting a legal precedent addressing this issue.en
dc.descriptionSiempre que nos referimos al termino Inmunidad Diplomática, lo relacionamos con el principiode Igualdad Soberana entre los Estados (Par In Parem Not Habet Imperium), entendiendoesta como la imposibilidad absoluta de ejercer jurisdicción sobre otro Estado, incluyendosus agentes, que en el ámbito internacional se conocerán como Agentes Diplomáticos.La nueva tendencia en materia de inmunidad se encamina hacia el concepto de InmunidadRestringida, mediante el cual se aplicará dicha inmunidad solo en los casos en que un Estadoo su agente ejecute actos propios de su función (Jure imperi), en caso contrario se aplicaranlas normas vigentes en el Estado del Foro.Es en razón a esta nueva tendencia que debemos evolucionar y cambiar la antigua mentalidadabsolutista en materia de inmunidad jurisdiccional que venía imperando, armonizándolacon la era de los derechos humanos y su efectivo goce, pretendiendo definir esa delgada líneaque separa Inmunidad de Impunidad, y esto solo se logrará cuando el legislador y los jueces,quienes son los encargados de proferir y hacer cumplir las leyes que rigen a los ciudadanos ya los extranjeros que se encuentren dentro del país, entiendan la importancia y necesidad desentar un precedente jurídico frente a este tema.es
