En el presente artículo se plantea la problemática de inexistencia de una modalidad de selección determinada para llevar a cabo el proceso de selección de intermediarios de seguros en contratación estatal en Colombia, buscando identificar los aspectos negativos y positivos, lo anterior desde un análisis del objeto del asesoramiento en seguros, sus funciones y sus servicios prestados a las entidades estatales.
Para la consecución de tal fin se desarrolla un análisis de la normatividad de la intermediación de seguros en Colombia y de la contratación estatal, exponiendo con ejemplos y datos las diferentes modalidades de selección utilizadas que actualmente están desarrollando las entidades estatales para el objeto de la selección de intermediarios de seguros.
La información recopilada y analizada permitirá la comprensión de las diferentes limitantes y consecuencias de no contar con una modalidad de selección establecida para contratar intermediarios de seguros.
Abstract
This article addresses the problem of the lack of a specific selection method to carry out the selection process of insurance intermediaries in state contracts in Colombia, seeking to identify the negative and positive aspects, the above from an analysis of
the object of insurance advice, its functions and the services provided to state entities.
To achieve this goal, an analysis of the regulations of insurance intermediation in Colombia and state contracts is developed, exposing with examples and data the different selection methods currently used by state entities for the purpose of selecting insurance intermediaries.
The information collected and analyzed will allow the understanding of the different limitations and consequences of not having an established selection method to hire insurance intermediaries.
