dc.descriptionThis article discusses a critical analysis about the creation of the agrarian jurisdiction in Colombia and the impact that the declaration of the farmer as a subject of especial constitutional protection will have on its substantial and procedural practice. To it, the sufficiency of the current procedural subjects theory will be reviewed based on the fifty third article of the general procedural code regarding how effective it is to solve some controversies that come from the agrarian declarative processes in terms of environmental and procedural sustainability and fundamental guarantees as the due process and justice access. Finally, we will set out the challenge that this means to the agrarian jurisdiction judges.en-US
dc.descriptionEste artículo presenta un análisis crítico frente a la creación de la jurisdicción agraria en Colombia y la incidencia que la declaración del campesino como sujeto de especial protección constitucional tendrá en la práctica sustancial y procesal de esta nueva jurisdicción. Para ello, se revisará la suficiencia de la teoría de los sujetos procesales según el artículo 53 y siguientes del Código General del Proceso, respecto a qué tan efectiva resulta para resolver controversias surgidas de las particularidades del proceso declarativo agrario en cuanto a sostenibilidad ambiental y procesal, y de garantías fundamentales como el debido proceso y el acceso a la justicia. Finalmente se reflexiona sobre el reto que esto representará para los jueces de la precitada jurisdicción.es-ES
