El presente artículo analiza la figura del daño fiscal ambiental como una categoría
emergente dentro del control fiscal colombiano. A partir del marco constitucional y legal vigente,
se exponen los elementos estructurales de esta figura, las metodologías para su valoración
económica y los principales desafíos que enfrenta la Contraloría General de la República para
consolidar un modelo eficaz de responsabilidad fiscal ambiental. Mediante el análisis de casos
emblemáticos y la revisión normativa, se propone fortalecer el enfoque preventivo y sancionatorio
del control fiscal con perspectiva ecológica. Se concluye con propuestas normativas e
institucionales para mejorar la protección del patrimonio público frente a la degradación ambiental.
Abstract
This article analyzes the concept of environmental fiscal damage as an emerging category
within Colombian fiscal control. Based on the current constitutional and legal framework, it
presents the structural elements of this concept, the methodologies for its economic valuation, and
the main challenges facing the Comptroller General of the Republic in consolidating an effective
model of environmental fiscal responsibility. Through the analysis of emblematic cases and a
regulatory review, it proposes strengthening the preventive and punitive approach to fiscal control
from an ecological perspective. It concludes with regulatory and institutional proposals to improve
the protection of public assets against environmental degradation
