dc.descriptionEste artículo presenta cómo en el Art. 270 del Código Penal Italiano la asociación subversiva de personas, con el propósito de alterar o interrumpir violentamente la situación económica y social constituye un delito visto a la luz de lo sucedido con el fascismo. Se expone la siguiente revisión: el delito de asociación subversiva: características generales del caso; La génesis del delito de asociación subversiva y su relación con el delito político; el problema de la validez del artículo 270 del Código Penal después d el final del régimen fascista; las preguntas de la  constitucionalidad del delito de asociación subversiva; la relación entre el artículo 270 del Código Penal y el artículo 270 siguientes; los problemas político-jurídicos del artículo en ajuste al 270 del Código Penal y, en general, la categoría de delito político, y los sistemas democráticos de los proyectos de reforma. Y se finaliza con algunas observaciones en las que se concluye que es necesaria una nueva legislación porque no hay legitimidad del Estado democrático por lo que la jurisprudencia ha insistido en la legalidad haciendo una interpretación a manera de evolución.AbstractThis article and Article 270 of the Italian Penal Code subversive association of persons for the purpose of altering or violently disrupt the economic and social situation is a crime seen in the light of what happened to Fascism. It exposes the following revision: The crime of subversive association: general characteristics of the case, The genesis of the crime of subversive association and its relation to political crimes; The problem of the validity of Article 270 of the Penal Code after the end of the fascist regime; The questions of the constitutionality of the crime of subversive association; The relationship between Article 270 of the Penal Code and Article 270 ff; political and legal problems of adjustment to article 270 of the Penal Code and in general, the category of political crime and democratic process of reform projects. And ending with some comments which concludes that new legislation is needed because there is no democratic legitimacy of the state so the law has insisted on the legality of making an interpretation by way of evolution.es-ES
