The main thesis of the author sustains that the Nature of the Social State of Law, defined by the 1991 Constitution in order to define the Colombian State, determined the dynamic of the Constitutional Control in charge of the Constitutional Court, which has brought different types of sentences that are not only excluding the order of the rules that are incompatible with the Constitution, but, in the field of the fundamental rights. en
dc.descriptionEl presente artículo constituye la versión escrita de la ponencia presentada por el autor en el Marco del Seminario de “Derecho Comparado” celebrado en el mes de marzo en la Universidad Santo Tomás. La tesis fundamental del autor, sostiene que la Naturaleza del Estado Social de Derecho, definida por la Constitución de 1991 para caracterizar al Estado Colombiano, determinó la dinámica del Control Cons- titucional a cargo de la Corte Constitucional, lo cual ha dado lugar a diversos tipos de sentencias que ya no sólo buscan excluir del ordenamiento las normas incompatibles con la Constitución, sino confe- rirle vigencia material a los mandatos de ésta, particularmente en el campo de los derechos funda- mentales.es
