Conciliation, access to the administration of justice and due process of evidence: a relationship called to review in times of transformation

Resumen
En la investigación se identificó las tendencias en la aplicación de criterios en materia probatoria y el cumplimiento de los objetivos del acceso a la administración de justicia y debido proceso. Sin embargo, estos derechos se han abordado desde la perspectiva del proceso judicial, por tal motivo, se revisará desde otras formas de resolución de conflictos como son los Mecanismos Alternativos de Resolución de Conflictos (MARC), especialmente, la conciliación.
En este artículo se abordará por un lado, el desarrollo jurisprudencial por parte de la Corte Constitucional de la conciliación desde el derecho del acceso a la administración de justicia, por otro lado, los pronunciamientos desde el ámbito interamericano y finalmente, resaltando como estos métodos no pueden relacionarse únicamente como estrategias complementarias que permiten la descongestión judicial, y no como un método eficaz de Justicia Transformadora que permita asegurar a todas las personas sin distinción alguna la satisfacción de sus necesidades o capacidades relacionadas con la justicia.
The research identified the trends in the application of criteria in evidentiary matters and the fulfillment of the objectives of access to the administration of justice and due process. However, these rights have been addressed from the perspective of the judicial process, for this reason, it will be reviewed from other forms of conflict resolution such as Alternative Conflict Resolution Mechanisms (MARC), especially conciliation. This article will address, on the one hand, the jurisprudential development by the Constitutional Court of conciliation from the right of access to the administration of justice, on the other hand, the pronouncements from the inter-American sphere and finally, highlighting how these methods do not they can only be related as complementary strategies that allow judicial decongestion, and not as an effective method of Transformative Justice that allows to ensure to all people without any distinction the satisfaction of their needs or capacities related to justice.
